Josette Eugeni and Jeff Sylvestre advise that they do not have any comments at this time subject to the Court referring the Drainage report back to the Drainage Engineer for revisions.
The Drainage Engineer, Mark Hernandez, explains that there were revisions discussed that the Public Council Meeting held on February 8, 2022. There are three items in the drainage report that were identified and require revisions. He advises the first recommended revision is to Schedule C of the Drainage Report. Prior to finalizing the report, the land noted for Roll No.570-48900 had been based on the preceding drainage report from 1971. During the Public Information Centre, the property owners indicated that the drainage area noted was greater than what is taking place in the field. The area was revised accordingly following an onsite review and the report was finalized. However, this change had an unintended consequence of increasing the influence of the frontage benefit due to the now long linear shape. Hence the recommended frontage benefit for this property should be reconsidered.
The Drainage Engineer explains a recommended revision to Schedule D for Roll No. 570-48950 as the property had been identified as non-agricultural in the drainage report and it should be revised to agricultural. He indicates this would be a quick revision to complete.
Thirdly, he advises of a recommended revision to Schedule E, through discussions with the delegates the residential area factors for the properties along Lesperance Road were based on those typically used for lands that have both pervious and impervious features such as roofs, driveways and lawns. As it is only the rear yards being assessed in this circumstance, he recommends that the area factors be revised to reflect grass areas.
The Drainage Engineer indicates that no other affected property owners or concerns related to the assessment schedule have come forward.
In response to a query, the Drainage Superintendent advises that if the report is returned to the Drainage Engineer for reconsideration, the reconsidered report will be sent to the affected landowners, along with a notice for a second sitting of the Court of Revision for the members to consider the reconsidered report and hear any appeals for the reconsidered report.
