The Mayor calls the meeting to order at 6:47 pm.

Reporting Out of Closed Session

An electronic In-Camera Meeting of Council was held earlier this afternoon at 4:45 pm in accordance with Section 239.2(b) (c) (d) (h) and (i) of the Municipal Act, 2001, which permits a meeting or part of a meeting to be closed to the public if the subject matter being considered is:

• personal matters about an identifiable individual, including municipal or local board employees; and
• labour relations or employee negotiation;
• a proposed or pending acquisition or disposition of land by the municipality;
• information explicitly supplied in confidence to the municipality or local board by Canada, a province or territory or a Crown agency of any of them;
• a trade secret or scientific, technical, commercial, financial or labour relations information, supplied in confidence to the municipality or local board, which, if disclosed, could reasonably be expected to prejudice significantly the competitive position or interfere significantly with the contractual or other negotiations of a person, group of persons, or organization.

Introduction and Purpose of Meeting

The purpose of the meeting is to hear comments from any affected landowners on the proposed drainage works, as set out in the Drainage Report filed on August 25, 2021 by Gerard Rood, P.Eng, of Rood Engineering Inc., for the repair and improvement of the McLean-Hergott Drain.

The Drainage Superintendent advises that the Town received a call from one of the affected landowners who expressed concerns with the cost of the culvert, future maintenance costs and inquired on the reason for the culvert. 

The Drainage Superintendent advised the property owner that the Town will cover the cost of the installation of the culvert and due to his property location, he is not responsible for future maintenance costs. The culvert is being installed in order to be able to use the fire hydrant by the water department.

The Drainage Engineer explains the Essex Region Conservation Authority's response to the proposed drainage works required an amendment to page 5 of the drainage report, that the drainage works would not have any adverse effects to the upstream or downstream flow of the drain.

PWES-2021-39 Request to Consider Engineer's Report - McLean-Hergott Drain

  That the Report and Specifications for the McLean-Hergott Drain (Drain) as prepared by Gerard Rood, P.Eng., of Rood Engineering Inc., dated August 25, 2021 (Drainage Report) be received as amended at page 5 to address the concerns by the Essex Region Conservation Authority with respect to Section 28 of the Conservation Authorities Act;

  And that consideration be given to first and second readings of Provisional By-law No. 2021-77 to adopt the Drainage Report in accordance with Section 45 of the Drainage Act (Act);

  And further that notice be given to all affected landowners of the Court of Revision to be held on November 9, 2021 at 6:30pm in accordance with Section 46(1) of the Act, subject to the adoption of the provisional By-law.
