He comments that there is no water in their portion of the drain. He displays pictures of the drain's condition and the trickle of water flowing.
The Drainage Engineer, Mark Hernandez, outlines that the drainage report as appended to the agenda, was prepared in accordance with Section 76 of the Drainage Act. Section 76 of the Drainage Act provides for the variation of the assessment for the maintenance and repair of drainage works but does not allow for changes to the physical drainage works as shown in the current by-law.
In response to an inquiry on maintenance, the Drainage Superintendent outlines the Cyr Drain maintenance history. He advises that the pictures submitted by Mr. MacDonald indicate that maintenance is required on this drain. The Drainage Superintendent explains the process for a property to be removed from a drainage watershed and advises if a property is removed from one watershed, it would need to be added to another watershed.
In response to an inquiry regarding the recent land development in the area along County Road 22 and potential impacts to the Cyr Drain, the Manager Engineering Services comments that the development of the Subaru Dealership included stormwater management for the runoff from their property. The Manager Engineering Services advises the Cyr Drain provides the legal drainage outlet for the affected properties and the Town is obligated to keep the Cyr Drain in a proper state of repair
