The Mayor calls the meeting to order at 7:15 pm.

An electronic In-Camera meeting was held earlier this afternoon at 5:35 pm, which was closed to the public under section 239 (2) (e) and (f) of the Municipal Act, 2001 which permits a meeting, or part of a meeting, to be closed to the public when the subject matter being considered is litigation or potential litigation, including matters before administrative tribunals affecting the municipality or local boards; and advice that is subjected to solicitor-client privilege, including communications necessary for that purpose. 

At the meeting, Council received legal advice regarding notification of potential litigation regarding the Riverside Trail and defamatory comments on social media towards Administration and Council.

The Moment of Silence is waived in light of the electronic holding of this meeting.

The National Anthem is waived in light of the electronic holding of this meeting.

    That the recommendation from the Town’s Consultants, Bezaire Partners and Dillon Consulting Limited, to proceed with the installation of a recreational multi-use trail on the south side of Riverside Drive from the Tecumseh-Windsor border to Manning Road be adopted;

    And that the Riverside Drive Trail project proceed to the detailed design stage and in accordance with the recommendations from the Town’s Consultants and that the detailed design be reported back to Council.

    That the scheduling of a public meeting, on July 27, 2021 at 6:30 p.m., in accordance with the Planning Act, for the application submitted by John White to amend the Sandwich South Zoning By-law 85-18 by rezoning a 0.78 hectare (1.93 acre) property situated on the north side of North Talbot Road, approximately 110 metres (360 feet) west of its intersection with 9th Concession Road (5648 North Talbot Road), from “Agricultural Zone (A-33)” to “Hamlet Residential Zone (RH)” in order to facilitate the creation of one new residential lot and the future construction of one single-unit dwelling, be authorized.

    And that a by-law having the effect of amending the adopted new Tecumseh Official Plan by changing the land use designation for a 2.29 hectare (5.66 acre) parcel of land situated on the south side of Dillon Drive, approximately 40 metres east of its intersection with St. Pierre Street (12433 Dillon Drive and former McColl Street Right-of-Way), from “Community Facility” to “Residential” and “Recreational”, in order to facilitate the development of the lands for a 55-unit residential development consisting of six, two-storey townhouse dwellings totalling 23 units, two, two-storey stacked townhouse dwellings containing 16 units each and a municipal park in keeping with PBS-2021-32, be adopted;

    And further that a by-law having the effect of amending the Tecumseh Zoning By-Law 1746 by:

    1. adding a new definition for a “Stacked Townhouse Dwelling”; and
    2. rezoning a 2.29 hectare (5.66 acre) parcel of land situated on the south side of Dillon Drive, approximately 40 metres east of its intersection with St. Pierre Street (12433 Dillon Drive and former McColl Street Right-of-Way) from “Community Facility Zone (CF)” and “Residential Zone 1 (R1)” to “Holding Residential Zone 3 (H)R3-19” and “Recreational Zone (RE)”

      in order to facilitate the development of the lands for a 55-unit residential development consisting of six, two-storey townhouse dwellings totalling 23 units, two, two-storey stacked townhouse dwellings containing 16 units each and a municipal park in keeping with PSB-2021-32, be adopted.

    Whereas at the Regular Council Meeting on June 8, 2021, Tecumseh Town Council received a follow up report from the April 13, 2021 Regular Council Meeting when Council moved to
    reconsider their earlier decision to opt-out of retail cannabis in Town;


    And Whereas Tecumseh Town Council voted to opt-in allowing for retail cannabis stores to
    operate within the Town of Tecumseh, understanding that the Alcohol and Gaming Commission of Ontario (AGCO) provides final approval of all applications for cannabis retail stores;


    And Whereas the Province of Ontario’s only restriction related to the location of retail cannabis stores under the Cannabis License Act is a 150 metre distance between the store and any school with no other allowances for the municipality to put other limits in place such as additional buffer distances from other sensitive land uses;


    And Whereas municipalities are permitted to put in place a policy to recommend further
    protections to vulnerable populations and sensitive land uses.


    Now Therefore Be It Hereby Resolved:


    That the Tecumseh Town Council requests that Administration develop a policy, as
    recommended by the Windsor-Essex County Health Unit (WECHU) and with the consultation of the WECHU, to expand on the limited restrictions imposed by the province for the protection of our vulnerable populations and sensitive land uses such as daycares, parks, and youth and mental health centres to further influence the location of retail cannabis stores;


    And That the proposed policy be provided to Council for consideration of adoption at the next Policies & Priorities Committee meeting.
