The Mayor calls the meeting to order at 7:00 pm.

An electronic closed meeting was held at 6:00 pm in accordance with Section 239 (2)(b) (c) (d) (e) (f) (h) (i) (j) and (k) of the Municipal Act, 2001.

At the meeting, the Members:

  • approved the negotiated employment agreement with the Tecumseh Firefighters Association;
  • received advice regarding the appointment of legal counsel on employment matters;
  • gave direction on Acting Pay to two managers whilst servicing in an acting capacity for their respective Directors, and
  • gave an update on a potential land acquisition.

The Moment of Silence is waived in light of the electronic holding of this meeting.

    That Report LCS-2021-35 entitled “Urban Hens Licensing Pilot Program – Final Report”, be received;

    And further that in accordance with the Urban Hens Licensing Pilot Program By-law No. 2021-43, all current licenses issued under the two-year Urban Hens Licensing Pilot Program be terminated as of March 1, 2022;

    And furthermore that all property owners in the urban area be given notice to remove their hen coop and run, and to re-home their hens, no later than March 1, 2022, unless ordered to remove earlier.

    That LSC-2021-37 entitled “Indigenous Land Acknowledgement Statement” be received;

    And that the following Land Acknowledgment Statement be approved and kept as a living document, open for revisions for one year to allow for feedback on the Statement and related advice regarding its use:

    We acknowledge that we are on land and surrounded by water, originally inhabited by Indigenous Peoples who have travelled this area since time immemorial. This territory is within the lands honoured by the Wampum Treaties; agreements between the Anishinaabe (Ah-nish-e-naa-bay), Haudenosaunee (Hoe-den-oh-show-nee), Lenni (Len- eh) Lenape (Le-naw-pay) and allied Nations to peacefully share and care for the resources around the Great Lakes. Specifically, we would like to acknowledge the presence of the Three Fires Confederacy (Ojibwe (Oh-jib-way), Odawa (Oh-dah-wah), Potawatomi (Paw-taw-watt-oh-me) and Huron/Wendat (Wen-dat) Peoples. We are dedicated to honouring Indigenous history and culture while remaining committed to moving forward respectfully with all First Nations, Inuit and Métis.

    And further that subject to the approval of the Land Acknowledgement Statement, the Procedure By-law be amended to codify the reciting of the Statement at meetings of Council and Committees.

    And further that the strategy and projects highlighted in this report be provided for Council’s consideration in the 2022 5-Year Lifecycle Capital reports for Parks and Arena.

    And that By-law No. 2021-97 be approved to authorize the Mayor and Clerk to execute the Source Protection Plan, Part IV Enforcement Transfer Agreement Amendment No. 2 satisfactory to the Town of Tecumseh (Town) and Essex Region Conservation Authority (ERCA), to extend the agreement to December 31, 2024.

    And further the Town’s estimated cost share of $4,000 be funded from the Water Operational Budget.

Riberdy Farms 

A Member requests that Administration contact the owner of Riberdy Farms regarding concerns about their property and the Riverside Drive multiuse trail.

Tree Branch Collection

A Member requests after the wind storm earlier in the week,  Administration collect the large branches along the roadways, and for the Town's Arborist to inspect the trees for the safety of the community. 

Passing of Mr. Finbarr O’Connor 

The Members expresses condolences on the passing of Finbarr O'Connor and acknowledged his role in the Town's twinning community in Oldcastle, County Meath, Ireland.    

Turkey Creek Watershed Project- Phase 2

The Director Public Works and Engineering Services provides an update on the Turkey Creek Watershed project which is moving forward with phase 2.

    Whereas broadband has become an essential service that is necessary to encourage economic growth and stability, modernize and streamline the delivery of health and social services, provide greater educational opportunities, increase capacity to administer and govern institutions, improve the environment, and create fairness and opportunity for everyone;

    And Whereas the Western Ontario Wardens’ Caucus (WOWC):


    • Represents 15 upper and single tier municipalities in Southwestern Ontario with more than three million residents; and
    • Recognizes that universal access to high-speed broadband connectivity is fundamental to the continued relevance and future prosperity of small urban /rural communities in Southwestern Ontario.

    And Whereas WOWC’s desired outcomes would see the Province of Ontario’s
    Accelerated High Speed Internet Program (AHSIP): 


    • Maximize the amount of fibre deployed with the funds available;
    • Provide a level playing field that allows high participation of local and regional
    Internet Service Providers (ISPs); and
    • Ensure equitability of funding and outcomes between all municipalities in
    Southwestern Ontario (lower- and upper-tier).

    And Whereas Infrastructure Ontario (IO) released RFQ No. 21-048: Request for
    Qualifications for Accelerated High Speed Internet Program on September 9, 2021;

    And Whereas WOWC supports the Province of Ontario’s program and want it to be
    as effective as possible;


    Now Therefore Be It Hereby Resolved That the Council of the Town of Tecumseh
    send a letter, in addition to the letter sent by the Chair of the Western Ontario Wardens’
    Caucus, to the Minister of Infrastructure, The Honourable Kinga Surma, copying the
    Premier of Ontario, The Honourable Doug Ford, and MPPs of Southwestern Ontario,
    recommending that Infrastructure Ontario pause the procurement process until the
    following recommendations have been addressed:


    • Lot sizes are reduced to an average reserve price of $10M with no single lot
    having a reserve price greater than $20M;
    • “Wired” and “Wireless” designations are removed from the lots in line with
    Infrastructure Ontario’s (IO) amendment to allow hybrid bids in all lots, with
    "Wired" connectivity as the preferred option;
    • Reserved prices are recalculated for all lots and are based on hybrid solutions
    rather than “Wired” or “Wireless” solutions;
    • A clear / transparent formula for evaluating proposals that balances bid price with
    higher fibre content bids is created and communicated to participants;
    • The Request for Proposals (RFP), when issued, be made visible to the public
    given that it contains no propriety Internet Service Provider (ISP) information;
    • Immediately release the lot maps to all municipalities in Ontario so that they can
    review and comment;
    • Ensure that small ISPs in Southwestern Ontario are consulted directly and their
    input is considered;
    • The details of the procurement be re-evaluated and IO consider the following
    changes:
    • Allow for progress payments to the recipients rather than holding 100 per cent of
      the funding until customers are in-service;
    • Eliminate the bid bond requirements;
    • Seriously reconsider the position that the Construction Act applies / eliminates the  bonding requirements called for by the Act (especially if no progress payments are being made);
    • Eliminate the plan to hold back the final 10 per cent and pay 100 per cent of the project cost by the time the project is complete.
